PRIVACY POLICY

Assima Canada Inc. (the “Company”) is committed to maintaining robust privacy protections for its users.  Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Services.

For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at 
https://assima.net/. “Services” refers to the Company’s services accessed via the Site, the Company’s Applications(Train, Assist and Collaborate) and any requisite Extensions and Tools, The terms “we,” “us,” and “our” refer to the Company. The terms “client,” “customer,” and “You”  refers to you, as a user of our Site or our Services.

By accessing our Site or our Services, you accept our Privacy Policy and “Terms and Conditions” (found here: https://assima.net/terms-and-conditions/), and you consent to our collection, storage, use and disclosure of your Personal Information as described in this Privacy Policy.

1. INFORMATION WE COLLECT

We collect “Non-Personal Information” and “Personal Information.” 
Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks. Personal Information may include;
a. Your name, email address, company name and phone number
b. Customer relationship information such as customer requests, feedback and other information you provide such as when you receive a customer support
c. Information related to employment, such as your employment history, academic history, your skills, personal and work experience, and compensations
d. Information provided during sign up to participate in or receive a service from us, such as newsletters, competitions, live chats, or register for upcoming events with us
e. HTML Elements, HTML Attributes, CSS, images, URL, page title, input value already present or typed by the end-user
f. Interactions with HTML elements on a webpage such as click events, mouseover events and in browser tab operations.

Any combination of the aforementioned Personal Information may be collected, depending on the Company’s Services used by you.

The Company also uses cookies and collects IP addresses (an IP address is a number that can uniquely identify a specific computer or other network device on the internet). We use analysis software to look at IP addresses and cookies for the purpose of enhancing your user experience. This information is not used to develop a personal profile of you and the log files are regularly purged.

2. INFORMATION COLLECTED VIA TECHNOLOGY

To use our Services, you may need to provide Personal Information, which may include: your name, email address and phone number. However, in an effort to improve the quality of the Services, we track information provided to us by your browser or by our software application when you view or use the Service, such as the website you came from (known as the “referring URL”), the type of browser you use, the device from which you connected to the Services, the time and date of access, and other information that does not personally identify you. We track this information using cookies, or small text files which include an anonymous unique identifier. Cookies are sent to a user’s browser from our servers and are stored on the user’s computer hard drive. Sending a cookie to a user’s browser enables us to collect Non-Personal information about that user and keep a record of the user’s preferences when utilizing our services, both on an individual and aggregate basis. For example, the Company may use cookies to collect the following information:

a. Customer behaviour and navigation
b. Collect log file data for our Services use
c. Code execution tracking in our Services

The Company may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser.


3. CHILDREN'S PRIVACY

The Site and the Service are not directed to anyone under the age of 13. The Site does not knowingly collect or solicit information from anyone under the age of 13. In the event that we learn that we have gathered personal information from anyone under the age of 13 without the consent of a parent or guardian, we will delete that information as soon as possible. 4. HOW WE USE AND SHARE INFORMATION

Personal Information:

Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share Personal Information with vendors who are performing services for the Company, such as the servers for our email communications who are provided access to user’s email address for purposes of sending emails from us. These vendors use your Personal Information only at our direction and in accordance with our Privacy Policy.

In general, the Personal Information you provide to us is used to help us communicate with you (for reasons explained in Section IV). For example, we may use Personal Information to:

a. To provide you information that will allow you to use our products and services
b. To analyze and improve the services offered by the Company. e.g. to provide you with the most user-friendly experience with the Company’s products and services
c. for “service administration purposes”, which means that the Company may contact you for reasons related to the service you have signed up for (e.g. to provide you with password reminders)
d. to contact you about a service or information you requested
e. to create web and application traffic analytics and block disruptive use

We may share Personal Information with outside parties if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce applicable “Terms and Conditions”, including investigation of potential violations; address fraud, security or technical concerns; or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law.

Non-Personal Information:

In general, we use Non-Personal Information to help us improve the Service and customize the user experience. We also aggregate Non-Personal Information in order to track trends and analyze use patterns on the Site. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion.

In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy. If our information practices change at any time in the future, we will post the policy changes to the Site so that you may opt out of the new information practices. We suggest that you check the Site periodically if you are concerned about how your information is used.

5. HOW WE PROTECT INFORMATION

We implement security measures designed to protect your information from unauthorized access. Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, End-Point Protection systems and firewalls. However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using our Service, you acknowledge that you understand and agree to assume these risks.

6. WHEN WILL WE CONTACT YOU

The Company may contact you for a variety of reasons, which may include:

a. Responding to your questions and requests. If you contact us with a problem or question, we will use your information to respond.
b. Sending you important transactional and/or administrative emails and messages about Services that you use. We may contact you to inform you about changes in our Services, our Service offerings, and important Service-related notices, such as billing, security and fraud notices. These emails and messages are considered a necessary part of the Services and you may not opt-out of them.
c. Sending emails about Company news or products that we think you’d like to hear about either from us or our business partners, in each case, under a legitimate business interest and/or based upon your request. If you are not interested in receiving these communications, you can always opt out of these types of messages at any time by clicking the unsubscribe link at the bottom of each communication or by following the instructions of the “What rights and choices do I have?” section of this Privacy Policy.
d. Conducting surveys. We may use the information gathered in the surveys to enhance and personalize our products, Services, and websites.
e. Offering referral programs and incentives, which allow you to utilize email, text, or URL links that you can share with friends or colleagues.

 
7. YOUR RIGHTS REGARDING THE USE OF YOUR PERSONAL INFORMATION

You can always review, update or change personal information from within your account or by contacting us. The Company will also, when you request, provide you with information about the types of information we process about you and whether we hold, or process on behalf of a third party, any of your personal information. You may have the right to a copy of your personal information.

You can also ask about:

a. whether and why we have your personal information;
b. how we obtained your personal information;
c. what we have done with your personal information;
d. to whom we have communicated your personal information;
e. where your personal information has been stored, processed or transferred;
f. how long we will retain your personal information or how that retention period will be determined; and
g. the safeguards in place to protect your information when it is transferred to third parties or third countries.

Finally, you can ask us: (a) not to collect or use your personal information for certain purposes; (b) to delete your personal information; or (c) to provide your personal information to a third party.

We may also collect information on behalf of our customers, to provide the Services, and we may not have a direct relationship with the individuals whose personal data is processed. If you are a customer or end-user of one of our customers, please contact them (as the data controller or legal equivalent) directly with any of these requests.

Depending on which laws apply to your personal information, we may only be able to fulfill some of the above requests for you. If you make a request and we have a justified lawful reason to maintain your information (e.g., legal and audit purposes), we will explain your legal rights, the reason we are maintaining such information and, if applicable, any recourse you may have.

We will respond to your request without undue delay. We reserve the right to take reasonable steps to verify your identity prior to granting access or processing changes or corrections.

If you wish to no longer receive marketing communications from us, you can opt-out of marketing by clicking on the unsubscribe link on any marketing email you receive.

You may also have the right to complain to a regulatory authority. If you have a question or complaint, we ask that you please contact us first. If you are in the EU and we are unable to resolve your complaint, you may complain to the Data Protection Authority in your home country.


8. LINKS TO OTHER WEBSITES

As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Site and the Service. Therefore, this Privacy Policy does not apply to your use of a third party website accessed by selecting a link on our Site or via our Service. To the extent that you access or use the Service through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them.

9. CHANGES TO OUR PRIVACY POLICY

The Company reserves the right to change this policy and our “Terms and Conditions” at any time.  We will notify you of significant changes to our Privacy Policy by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site. Significant changes will go into effect 30 days following such notification. Non-material changes or clarifications will take effect immediately. You should periodically check the Site and this privacy page for updates.
